Axtra Protect Terms and Conditions

Coverage

  • The TBM Axtra Protect Extended Warranty Plan provides coverage for parts and labor in respect on the Product stated on the Tan Boon Ming Sdn. Bhd. (494355-D) / TBM Sales Order / Sales Invoices for covered inherent mechanical and electrical breakdown only and only to the extent provided by the manufacturer of the coverage is concurrent with and extends beyond the Original Manufacturer’s Warranty and will commence upon expiry of the Original Manufacturer's Warranty and is provided only insofar as the obligations of the Original Manufacturer's Warranty are concerned. Period of coverage is subject to payment of the applicable fee for the Extended Warranty Plan selected. 
  • Mechanical or Electrical Breakdown shall mean the breaking or burning out (electrical) of any parts of the Covered Product arising from mechanical or electrical defect, causing a sudden stoppage of their functions, necessitating repair or replacement.
  • If this Extended Warranty is purchased for a computer system, this Plan covers the following components if purchased at the same time, all internal components resident within the computer system casing, monitor, keyboard, mouse, and speakers. 
  • On-site service charges for repairs are covered only if the original manufacturer's warranty states on-site service. Otherwise, the Service Contract Holder will pay on-site service charges. 

  • Product Eligibility

    The TBM Axtra Protect Extended Warranty Plan may only be purchased upon purchase of a Product and only covers a Product which is purchased new from TBM; 

    • Manufactured for domestic and personal use in Malaysia only; 
    • Included at the time of purchase the manufacturer's complete and original warranty valid in Malaysia; 
    • Service Contract Holder must be the same invoicing party as stated in the covered Product Sales Order / Sales Invoice / receipt of TBM.

    In the case of consumer products such as electronics and major appliances, the use is or has been limited to domestic and personal use. Office products such as facsimile machines, copiers, scanners, printers, and computers are covered for office, domestic and personal use. 

    For Repairs

    • If the manufacturer's warranty period for the Product has not expired, contact the manufacturer or their Authorized Repairer directly.
    • If the manufacturer's warranty period has expired and the TBM Axtra Protect Extended Warranty Plan is in effect, call 03-7983 2020 (TBM Service Careline) during office hours for product repair authorization. Repairs must only be carried out by TBM Axtra Protect Authorized Repair Center.
    • It shall be a term of this Extended Warranty Plan that in the event of a breakdown that may give rise to a claim for Repairs under this Plan, the equipment covered under this Plan must be presented to the Authorized Repairer within the covered period and in any case, within fourteen (14) days of the happening such event.
    • For all repairs, the TBM Axtra Protect sales order/cash sales document and this certificate for the product must be presented. 

    Consult your manufacturer's instructions to determine if the failure to operate is due to circumstances that may be corrected by yourself. If the breakdown is not covered by the Extended Warranty, you will be charged for the cost of the repair. 

    Termination and Cancellation

    Cancellation of this Extended Warranty is applicable only when the Product is returned or exchanged by TBM Axtra Protect within 15 days from the date of purchase. 

    This Extended Warranty Plan shall terminate immediately with no refund of the extended warranty fee in the event of any of the following: 

    • Commercial use (multi-user organizations), public rental, use for profit, or communal use for multi-family housing.
    • Subsequent sale of the Product when no written request to transfer this Extended Warranty Plan to the new owner has been received by TBM.
    • Repossession of the Product sold. 
    • Discovery of fraud or material misrepresentation. 
    • Unauthorized repair or replacement of covered products. 
    • If the Service Contract Holder disposes of the Product during the term of this plan, coverage will cease. 

    Limitation of Liability

    • The repair cost of the Component or Part (including labour charges & checking fee) up to the product original purchase price as stated in the TBM Axtra Protect Extended Warranty Certificate or Invoice whichever is lower or in total for all claims in the aggregate up to the maximum repair coverage per product covered.
    • TBM Axtra Protect will replace your product with one of like kind and quality if it is not repairable due to part discontinuity or beyond economic repair. Any replacement of your covered product in its entirety shall fulfill all TBM Axtra Protect's obligations under your Extended Warranty, and TBM Axtra Protect shall have no further obligations for the remainder of the term of this Plan, if any. Due to technological advances, the replacement product may be of lower retail value than the original Product. The replaced Product (the spoilt unit) shall become property of TBM Axtra Protect Administrator.
    • TBM Axtra Protect Administrator may replace your product with a new product that is nearest to the original product's technical specifications. In the event of replacement, the TBM Axtra Protect Administrator will take into account the features and specifications of the original product and the availability of the technology. The value of the replacement product, as measured by the current recommended selling price, shall not exceed the product original product price. Due to technological advances and availability, the replacement product may be of lower retail value than the original Product and is not limited to the manufacturer or brand of the original product. Replacement price differences, if any, will not be refunded in any form. The decision to repair or replace is always determined at TBM Axtra Protect Administrator’s sole discretion.
    • Coverage will not, under any circumstances, extend to any loss or injury to a person or loss or damage to property or any incidental, contingent, special, or any direct or indirect loss and consequential damages including but not limiting to losses incurred due to any delay in rendering service related to this Contract and loss of use during the period that your Product is at an authorized repairer and/or while awaiting parts.
    • Replacement parts will be new, original, or non-original manufacturer’s parts that perform to factory specifications of the product determined at the TBM Axtra Protect Administrator's discretion.
    • Decision to proceed for repair or replacement of the product determined at the TBM Axtra Protect Administrator's discretion.

    Transfer of Ownership

    • This Plan may be transferred to any subsequent owner of the Product by submitting in writing or contact TBM Service Careline within 10 days of the product transfer date to notify the name and address of the new owner.
    • In case the Product covered is replaced directly by the manufacturer during the manufacturer’s original written warranty, the Service Contract Holder must submit to TBM Axtra Protect the manufacturer's acknowledgment letter, delivery receipt, and with full details of model & serial number of both the old and new items within 10 days of the transaction.

    Coverage Exclusions

    This policy specifically does not apply to any liability arising out of the following: 

    1. Problems or defects not covered under the manufacturer’s original written warranty, repairer’s warranty, or any other warranties in effect. 
    2. Products that are still covered by the manufacturer’s original written warranty, repairer’s warranty, or any other warranties in effect. 
    3. Liability to anyone other than the Service Contract Holder, as the case may be. 
    4. The cost of repairs, replacement, parts, and labour costs which are caused by the manufacturer’s defects or inherent faults involving recall, modification, replacement, or repair of all products in a model range. Examples include but are not limited to external and internal sweating of fridge, freezer, and chiller. 
    5. Negligence of the Service Contract Holder of any kind. 
    6. Use of the service in any illicit trade or transportation or in the commission of a felony. 
    7. Appearance or structural items, such as housing, case or frame, decorative parts or parts designated to be replaced periodically during the life of the product. 
    8. Non-operating and cosmetic items, paint, color or product finish, accessories used in or with the eligible product; cables, cords, glass, lens, cartridges and stylus, tapes, add-on options incorporated in a product for which options are not essential to the basic function of the Product for which the Service Contract was purchased. 
    9. Repair, replacement or maintenance of items that have been subject to normal wear and tear such as cases, key caps, knobs, buttons, handles, bins, racks, filters, aircon swing blades, fan blade, door gasket, outer tub, pulsator, burner cap, burner head, antennas, remote control, battery chargers, or mechanical parts of the Product. 
    10. Consumables such as vacuum cleaner belts, toner, print or ink cartridges, bulbs, compact discs, digital tapes, etc. 
    11. Batteries, internal or external to the Product whether such batteries are rechargeable or not, and non-rechargeable OEM batteries. 
    12. Software (including operating system and any stored data), defects resulting directly from software installation and or removal, computer virus, virus prevention, and other peripherals. 
    13. Faults in any wiring, electrical connection or plumbing, piping, trunking, fitting, realigning of signal receivers (poor reception), and consequential loss of any kind. 
    14. Manufacturer’s recommended routine maintenance, inspection, cleaning, lubrication, adjustments or alignments, and other instructions. 
    15. Damage caused by accident, neglect, abuse, misuse, theft, sand, water damage (spillage of foods/liquids, exposure to moisture or dampness), improper ventilation, corrosion, rust, excessive heat, battery leakage, acts of god (including without limitation, events such as fire, flood earthquake, war, invasion, act of foreign enemy, hostilities or warlike operations, civil war, civil commotion), commercial use (multi-user organizations), public rental, use for profit or communal use for multi-family housing, power outages or surges, inadequate or improper voltage or current (fluctuation of electrical power, lightning, static electricity), improper environment or extreme thermal environment conditions (including lack of proper temperature or humidity). 
    16. Unauthorized modifications made to the Product and/or problems/defects arising from such unauthorized modifications; where the serial/IMEI on the product has been defaced, destroyed, removed or made illegible or has been tampered with: failure to follow manufacturers’ instructions on installation, operation or maintenance; repairs performed by non-authorized repairer; any items not affecting the function of the Product; image burn. Damage caused by unauthorized repair or replacement of covered products shall result in the cancellation of this plan. 
    17. Reception and transmission problems resulting from external causes. 
    18. Costs of removal or reinstallation unless specifically included in the Service Contract. 
    19. Any failure, malfunction, defect, inoperability, breakdown, disruption, or stoppage of the Product or any Product, functions or the functions of any related to, directly or indirectly any design, planning or engineering incompatibility. 
    20. Failure to follow manufacturer’s recommended instructions for installation, operation, routine care maintenance, inspection, cleaning, removal of odors, lubrication, external adjustments etc. including problems cause by a device that is not the Product, including equipment/accessories that are not OEM, whether or not purchased at the same time as the Product. 
    21. Repairs necessitated by accidental or intentional physical damage (such as chipping, denting, scratching & etc.). 
    22. Cracked glass due to omission, negligence or default. 
    23. Damage due to organic infestation, animal and insect infestation (from internal and/or external sources). 
    24. Commercial usage (multi-user organizations), abnormal long usage hours (including without limitation, usage of TVs for CCTV, public viewing at customer waiting area, announcement board & etc), public rental, use for profit or communal use for multi-family housing. 
    25. Repairs to hardware that has been added after the original purchase of the Product. 
    26. Shipping charges and damage, express service charges, transportation damage, removal, installation or reinstallation of the Product, products on loan during the repair process. 
    27. Any costs incurred where no fault is found or the fault is not covered under this Policy. 
    28. Repairs where prior authorization has not been obtained. 
    29. Damages caused by repair work or failure to perform repair work by the TBM Axtra Protect Authorized Dealer, its agents or employees, or any other Repair Facility, its agents or employees. 
    30. If the product is moved out of the country of purchase, it will not be covered by this Extended Warranty. 
    31. Exclusions specifically stated in the Service Contract hereto.

    ENTIRE AGREEMENT 

    This is the entire agreement between TBM Axtra Protect and the Purchaser of the Product and no other oral or written representation is valid. In the event of any inconsistency between the English text and text in other languages, the English version shall prevail. 

    THIS EXTENDED WARRANTY IS NOT AN INSURANCE POLICY. IT IS A SERVICE CONTRACT PROVIDING REPAIRS FOR COVERED DEFECTS. IT DOES NOT PROVIDE ANY GUARANTEE OR PROMISE RELATING TO THE NATURE OF THE MATERIAL, WORKMANSHIP OR PERFORMANCE OF THE COVERED PRODUCT.
