Standard Terms & Conditions
- Any variation to these Terms and Conditions (including any agreed between both parties) shall be inapplicable unless agreed in writing by TBM.
- Any damages, incorrect deliveries, duplicated orders, product mishandling, product malfunction and manufacture defect should be reported to TBM within 7 days of signed receipt to enable TBM to take appropriate action.
Sale of Goods
- The price shall be the Recommended Retail Price less agreed discount, unless otherwise agreed in writing between both parties. The final price is inclusive of any applicable taxes according to Malaysian Law.
- If full payment is not made while ordering or by the due date, TBM shall be entitled to:
- require balance payment before delivery;
- refuse to make delivery of any undelivered goods without incurring any liability to the Buyer for non-delivery or any delay in delivery.
- All purchased goods will only be kept for a maximum of two (2) months from the Date of Purchase without additional charges unless TBM is unable to make the particular goods available for delivery or collection within the stated period. Otherwise, any undelivered or uncollected goods will only be kept upon full payment and will be charged a storage fee of two per cent (2%) of its total value each month beyond the stated period.
- Unless otherwise agreed in writing, delivery of the goods shall take place at the address specified by the Buyer on, or as close as possible to the date required by the Buyer. The Buyer shall make all arrangements necessary to receive the goods when they are delivered.
- Any delivery or installation work that requires a second trip may be subject to additional logistics charges if it is due to circumstances beyond the control of TBM. The Buyer is required to provide all access and accurate information that is necessary for TBM to complete the deliveries or installation works.
- Additional logistics charges may incur for deliveries which are required for exchange or return of products not due to the fault of TBM, the manufacturer, or any logistics party.
- Any refundable deposit paid which is not used for two (2) years from the date of receipt shall be forfeited.
Supply of Service
- A minimal inspection fee shall be imposed for all over warranty equipment. However, the inspection fee shall be deducted should the Customer agree to proceed for repair. The final price is inclusive of any applicable taxes according to Malaysian Law.
- Unless a service order has been placed, TBM reserves the right to change the price of any services based on circumstances. Under no circumstances will TBM refund the difference of a performed service should the price of the service be reduced later.
- To enable TBM to perform its obligations, the Customer shall co-operate to:
- provide any information reasonable required by TBM;
- keep TBM informed of their correct name, postal address and contact information.
- TBM shall perform all services with reasonable skill and care to an acceptable standard in accordance with codes of practice.
- TBM shall ensure that any materials supplied or used for repair are free of defects at the point of dispatch.
- TBM shall keep all pending or completed service sets in storage for a maximum of 6 months from the last date of notification to Customer, for repair authorisation or completion, whichever is later. Any equipment that is not collected after the given period shall be disposed upon noticing the Customer.
- An original copy of Service Note is required for the collection of any equipment.
